YOUR ACCESS AND USE OF THE SERVICE IS SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS (THE “TERMS AND CONDITIONS”) AND ALL APPLICABLE LAWS. BY ACCESSING OR USING ANY PART OF THE SITE, YOU ACCEPT, WITHOUT LIMITATION OR QUALIFICATION, THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, YOU MAY NOT USE ANY PORTION OF THE SERVICE.
1. Authorized Use of This Site
This Site is provided by Health Insights, LLC, dba TriVoca Health pursuant to these Terms and Conditions solely for your personal, non-commercial use. The information contained on this Site is for informational purposes only. Any use contrary to as stated herein requires our prior written consent.
2. Eligibility
To register on our panel, you must (a) accept and agree to these Terms and Conditions; (b) register with us through the Site; (c) be at least 18 years of age and a U.S. citizen or legal resident with a valid tax identification number; and (d) provide all requested user information, such as valid government‑issued photo ID, applicable NPI and license information, and any additional information that may be required in accordance with our quality assurance standards. Participants are required to maintain accurate, current profile details, including demographic and contact information, and to promptly notify us of any changes to your user information.
3. Privacy
TriVoca Health is committed to protecting your personal information and safeguarding your privacy. We understand your concerns regarding the data you share with us and strictly adhere to applicable data protection laws and market research codes of conduct. Our Privacy Policy explains how information collected from you is used, and it ensures that all personal information remains confidential and is used solely for research purposes.
4. Code of Conduct
To ensure the integrity, quality, and professionalism of our research, all panel members are required to adhere to the following standards.
- Participants may maintain only one account and must provide truthful and accurate responses in all surveys, studies, and discussions.
- Responses must be in your own words. The use of Artificial Intelligence (AI) to formulate responses is prohibited.
- Members are expected to participate attentively, complete assigned activities in full, attend scheduled sessions on time, and engage respectfully with moderators, staff, and fellow participants.
- All research materials and discussions are confidential and may not be shared externally. Respect the confidentiality of all research materials and discussions, and do not share proprietary or sensitive information externally as per our non-disclosure agreement.
- Participants must conduct themselves in a clear and sober state, dress appropriately, avoid disruptive behavior (including profanity, aggression, threats, or violence), and refrain from posting or transmitting any unlawful, defamatory, obscene, or otherwise inappropriate material.
- Manipulation of the results of any panel, poll, survey, or sweepstakes, or to the Site is prohibited. This includes, but is not limited to the any action taken to interfere with the Site or other users use of or access to the Site, establishing links to or from any other website, the use of spiders, robots, data mining techniques or other automated devices or programs to catalog, download, store or otherwise reproduce or distribute content available on the Site. Use of, or access to the Site may not be sold to any third party.
- Unsolicited communication, such as promotions and/or advertising of products or services, is prohibited.
Failure to comply with these standards may result in removal from a session, termination of panel membership without prior notice, and forfeiture of any pending or earned incentives. We reserve the right to conduct quality assurance checks at any time to verify compliance, and all information provided must be accurate and must not misrepresent or mask a participant’s identity.
5. Account Termination
We reserve the right to terminate any account at any time without prior notice to you and without sharing the reason to do so based on the changes made for security and privacy purposes. If an account is terminated all reward points and/or incentives on the account will immediately expire and will not be reissued.
If your account has been terminated for breach of our Terms and Conditions any incentive credited or any ongoing redemption process will be terminated, and the funds will not be issued.
6. Incentives and Rewards
Healthcare Voices uses reward points to represent participant earnings. Remaining an active member of the Healthcare Voices’ community by participating in a survey, study, or community activity at least once every twelve months will ensure that your points will not expire. You may redeem the points or continue saving for higher-value rewards.
In accordance with federal tax regulations, we are required to obtain your tax details once your annual cumulative incentives reach $2,000. This is based on “claimed” rewards, irrespective if it is for virtual or physical cards.
All rewards and cards issued are subject to the applicable terms and conditions of the Virtual Reward Centre. The cardholder is solely responsible for compliance with those terms.
7. Sweepstakes and Promotions
Occasionally, TriVoca Health may offer or conduct panels, surveys, sweepstakes, reward points programs, or other promotions or programs (“Services”) in connection with this Site. All such Services shall be subject to any additional terms, conditions, rules, guidelines, or agreements that are provided to you at the time of accessing such Services. TriVoca Health reserves the right to change rewards or other incentives offered in connection with these Services.
8. Communications
Any communication or material you transmit to TriVoca Health, including any data, questions, comments, panel responses, suggestions, or the like is, and will be treated as nonproprietary. Except to the extent expressly covered by our Privacy Policy, anything you transmit or post may be used by TriVoca Health or its affiliates for any purpose, including but not limited to, reproduction, disclosure, transmission, publication, broadcast, and posting. Furthermore, TriVoca Health is free to use any ideas, concepts, know-how, or techniques contained in any communication you send without compensation and for any purpose whatsoever, including but not limited to, developing, manufacturing, and marketing products and services using such information.
9. Intellectual Property
TriVoca Health exclusively owns or is authorized to use and grant access to all components of the Site, including all text, graphics, designs, trademarks, service marks, copyrights, patents, and other intellectual property or proprietary rights contained therein. Unless these Terms and Conditions specifically allow it, you may not modify, copy, reproduce, create derivate works from, republish, display, upload, post, transmit, or distribute any content from this Site without TriVoca Health’s prior written permission. Accessing or using the Site does not grant you any license or rights to its content, and all rights not expressly provided in these Terms and Conditions remain with TriVoca Health.
10. Third-Party Information
This Site may contain (i) links to other websites not maintained by TriVoca Health or (ii) information about products or services of third parties. TriVoca Health does not independently verify the business practices of these third parties and makes no warranties on their behalf. The availability of any link or reference of any third party shall in no way constitute an endorsement by TriVoca Health of such third party. TriVoca Health is not responsible for the practices or content of other websites. The views and opinions expressed on this Site are not necessarily those of TriVoca Health.
11. Indemnification
You agree to indemnify, defend, and hold harmless TriVoca Health, its employees, directors, officers, agents, and representatives from and against any and all third party claims, demands, liabilities, costs or expenses, including reasonable attorney’s fees and expenses, arising from, or related to, any breach by you of any of these Terms and Conditions or applicable law, or otherwise arising out of your use of the Site or any content contained therein.
12. No Warranties
The Site, including all content or services made available on or accessed through the Site, is provided “as is.” To the fullest extent permissible by law, TriVoca Health makes no representations or warranties of any kind whatsoever regarding the content on the Site. Further, TriVoca Health disclaims any express or implied warranties, including, without limitation, non‑infringement, title, merchantability, or fitness for a particular purpose.
TriVoca Health does not warrant that the functions contained in the Site, or any materials or content contained therein, will be uninterrupted or error‑free; that defects will be corrected; or that the Site or the server that makes it available is free of viruses or other harmful components.
In no event shall TriVoca Health be liable under any theory of tort, contract, strict liability, or other legal or equitable theory for any lost profits, lost data, lost opportunities, costs of cover, exemplary or punitive damages, personal injury or wrongful death, or any special, incidental, indirect, or consequential damages, all of which are hereby excluded to the broadest extent permitted by law, regardless of whether either party has been advised of the possibility of such damages.
If any part of these warranty disclaimers or limitations of liability is found to be invalid or unenforceable for any reason, or if we are otherwise found to be liable to you in any manner, then TriVoca Health aggregate liability for all claims under such circumstances for liabilities shall not exceed ten dollars (US $10).
13. Severability
If any part of these Terms and Conditions shall be held or declared to be invalid or unenforceable for any reason by any court of competent jurisdiction, such provision shall be ineffective but shall not affect any other part of these Terms and Conditions and, in such event, such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law or applicable court decisions.
14. Waiver; Remedies
The failure of TriVoca Health to partially or fully exercise any rights or the waiver of TriVoca Health of any breach of these Terms and Conditions by you shall not prevent a subsequent exercise of such right by TriVoca Health or be deemed a waiver by TriVoca Health of any subsequent breach by you of the same or any other term of these Terms and Conditions. The rights and remedies of TriVoca Health under these Terms and Conditions and any other applicable agreement between you and TriVoca Health shall be cumulative, and the exercise of any such right or remedy shall not limit TriVoca Health’s right to exercise any other right or remedy.
15. Governing Law
The laws of the State of Delaware (without regard to its conflicts of law rules) shall govern these Terms and Conditions. You hereby expressly consent to exclusive jurisdiction and venue in the courts located in the state of Delaware for all matters arising in connection with these terms and conditions and your access or use of the site.
16. Changes
All information posted on the Site is subject to change without notice. In addition, these Terms and Conditions may be changed at any time without prior notice. We will make such changes by posting them on the Site. You should check the Site frequently for such changes. Your continued access of the Site after such changes conclusively demonstrates your acceptance of those changes.
